Proposed Law: no investigations into a sitting Prime Minister

MK Dudu Amsalem (Likud) has proposed a law that would put an end to investigations into a sitting prime minister for "light" crimes. Investigations into possible "serious" crimes will be allowed. As well, Statutes of Limitations for any such crimes will be frozen during the term of the prime minister so any investigation into these possible light crimes will be able to happen after the term of the PM will have been completed.

Amsalem explains the obvious - the job of PM is very important and the PM must remain focused on his job and not be distracted with all sorts of investigations. In the past 30 years there has not been a single Prime Minister that has not had investigations to deal with.

A light crime for this will be defined as any crime that bears a punishment of up to just 6 months in prison. Anything beyond that will be serious and will be allowed to be investigated during the term as well.

I think this is something that is necessary and I hope this law passes. I would add that I made a similar suggestion for such a proposed law both two months ago and 8 months ago, each time when new investigations into Netanyahu and his family were announced for minor issues.. Maybe Dudu Amsalem reads this blog...

  1. I think politically motivated criminal investigations need to stop. Period. This really doesn't address and can give a sitting Prime Minister an unfair advantage going into elections.

    Politically motivated investigations can still be launched against every single candidate going into an election except for the Prime Minister.

    Also as one of your reader's previously pointed out, as time goes on evidence disappears. Starting a legitimate police investigation with a cold case file, is a miscarriage of justice.

    1. Plenty of times the small investigation turns into a bigger crime - like Watergate, which under this proposal, would never have been investigated.

      And if presidents of world powers can handle it, I think Israel can too.

Daniel - the standard for impeachment of a sitting US president is "high crimes and misdemeanors" - a relatively vague description, but one that is generally understood to include only serious crimes. The point is not to prevent other issues being investigated, but to prevent them from interfering with a sitting president's ability to do his job.

      As it relates to Watergate - there would have been an investigation. There just would not have been charges if the crimes found did not rise to the constitutional standard for such.

  3. You seem to miss the point - if you're cutting out investigations into light crimes, you may miss the key point that directs you to a much larger crime.

    Second, where in the world other than dictatorships does the leader get a free pass on being investigated?
